GENERAL TERMS AND CONDITIONS OF SALE AND USE

Preamble

These General Terms and Conditions of Sale (GTC) govern the sale of products on the website https://cage-chastete.fr, operated by ECOM DROP - Théo PLANCKAERT
They include all information relating to the conditions of sale, delivery, returns, warranty and withdrawal, in accordance with Articles L.111-1 and L.221-5 of the French Consumer Code.
They replace and consolidate the separate policies previously available on the website (delivery, refunds, use).

Any order implies full and unconditional acceptance of these GTC. The customer acknowledges having read them before making any purchase.

Article 2 – Products and Availability

The products offered on the website are described and presented with the greatest possible accuracy.
However, photos are not contractually binding: minor variations may occur depending on screen display.

Products are available while stocks last. In the event of unavailability after an order has been placed, the customer will be informed by email and automatically refunded within 14 days.

All physical products offered are sourced from suppliers located in China.

Article 3 – Prices and Payment Terms

Prices are indicated in euros including all taxes (VAT not applicable, Article 293B of the French General Tax Code).
They may be modified at any time without prior notice but remain applicable at the time of order.

Full payment is required at the time of ordering.
Payments are accepted by credit card (Visa, Mastercard, AMEX, Bancontact, Twint) or SEPA bank transfer.

Transactions are secured via the Stripe payment platform.
The website retains ownership of the products until full payment has been received.

Article 4 – Delivery

Shipping fees:

Free in Europe for orders over €100 (otherwise €3.99)
€7.99 for the rest of the world

Delivery methods:

Home delivery
Collection point via Mondial Relay® (address sent by email once the parcel has been shipped)

Delivery times:

Order processing: 2 to 4 business days
Shipping: 10 to 15 business days (up to 2 months for overseas territories or non-European countries)

A tracking number is provided upon shipment.
Cage-chastete.fr cannot be held responsible for delays attributable to the carrier or circumstances beyond its control (strikes, customs, etc.).

Article 5 – Force Majeure

In the event of force majeure (strikes, war, epidemic, transport blockage, natural disasters, etc.), the parties’ obligations shall be suspended for the duration of the event without compensation.
If the situation lasts more than three (3) months, the contract may be automatically terminated.

Article 6 – Complaints, Returns and Refunds

1. Item not received:

If the parcel is not received within 30 business days, the customer may request:

a full refund, or
a free reshipment of the product.

The refund will be processed within a maximum of 14 days.

2. Damaged or non-conforming item:

The customer has 14 days from receipt to report a defective or non-conforming product.
A photo and brief description must be sent by email to contact@cage-chastete.fr.

The product must be returned new, complete, and in its original packaging.
After inspection, the customer may choose between:

a refund (within 7 business days), or
an exchange (reshipment within 30 days).

Article 7 – Right of Withdrawal

In accordance with Article L.221-18 of the French Consumer Code, the customer has 14 days from receipt to exercise their right of withdrawal without justification.

Products must be returned intact, complete, and unused to:

Return shipping costs are borne by the customer.
The refund will be processed within 14 days after receipt of the product or proof of shipment.

Article 8 – Legal Guarantee of Conformity

The consumer has a period of two years from delivery of the goods to invoke the legal guarantee of conformity in the event of a defect.

This guarantee entitles the consumer to repair or replacement within thirty days, free of charge.

If repair is requested but replacement is imposed, the legal guarantee is renewed for two years from the replacement date.

The consumer may also request a price reduction or termination of the contract under the conditions provided by Articles L.217-1 to L.217-32 of the French Consumer Code.

The consumer also benefits from the legal warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect.

Article 9 – Liability

The website cage-chastete.fr cannot be held liable for damages resulting from improper use of the purchased product or failure to follow instructions.
Liability can only be incurred in cases of gross negligence or intentional misconduct.

Article 10 – Consumer Mediation

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, any consumer may use a mediator free of charge for unresolved disputes.

Article 11 – Telephone Marketing Opt-Out (Bloctel)

In accordance with Article L.223-2 of the French Consumer Code, customers may register free of charge on the Bloctel opt-out list (www.bloctel.gouv.fr) to avoid telemarketing calls.

Article 12 – Applicable Law and Jurisdiction

These GTC are governed by French law.
In the event of a dispute, the consumer may bring proceedings before either the court of their residence at the time of contract conclusion or the place of delivery of the goods.
